III. Area Variance – Sharon Brooks, 401 CountyHwy 107, Johnstown, NY 12095 (SBL#163.-1-49)
Would like to buildfront deck 8’ X 20’. Town Law requires50’ setback from road. House is 40’ fromroad, and deck extends 8’ from front of house. Requests 18’ setback area variance.
Public Hearing opened at 6:01 pm
Public comments in favor: Sharon Brooks spoke in favor. Jack Wilson spoke in favor.
Public comments opposed: No opposition
Public Hearing closed at 6:02 pm
Zoning Board Action: Zoning board discussed, asked Todd Unislawski for his input, said he hasno concerns.

Area Variance – Borrego Solar(Elmwood Progressive LLC), Elmwood Ave., Gloversville, NY 12078
(SBL #135.-1-65.1) Due tounexpected variations in existing ground surface, additional variation in rackheight is needed to complete construction of our solar energy facility locatedon Elmwood Avenue in the Town of Johnstown. Relief from the maximum structure height of 8’ in the solar ordinance to11’ is needed. No impact to adjacentneighbors, as the project is significantly buffered by mature vegetation.
Dean Smith, Representative for Borrego Solar, explained thatthe need for the variance is due to the uneven surface of the topography. Joe Cirillo stated that under fulldisclosure, his cousin owns this property, but does not affect hisdecision.

Relief from the maximum structure height of 8’ in the solar ordinance to10’-6” is needed.
Dean Smith, Representative for Borrego Solar, explained thatthe need for the variance is due to the topography. Dean will bring exhibits to betterdemonstrate the need for the variance, to the Public hearing.

Randy asked where the energy is going. Dean explained they are distributed energyprojects, the energy is metered, and it is all paper from there.
