ORGANIZATIONAL MEETING
JANUARY 4, 2018

The organizational meeting of the Johnstown Town Board was held on January 4, 2018 at 4:00 PM at the Johnstown Town Hall with the following members present:

Also Present: Nancy Hart, Clyde Nellis, Kathy Canary

RESOLUTIONS:

Mr. Wilson offered the following resolution and moved its adoption:

#2018-1:

RESOLVED: That the salaries of the following Town Officials be and are hereby fixed in the annual amounts as follows:

Supervisor/Budget Officer: $14,950.00/$5,000.00

Town Justice: $15,242.00

Councilmen: $2,457.44

Town Clerk: $25,400.00

Longevity Program for clerks $ 50.00 per year, from 1-10 years

(Without insurance) $100.00 per year, from 11 years

FURTHER RESOLVED:

That the Supervisor be directed to pay Councilman their salaries in equal bi-weekly installments at the Board meetings.

Mr. Wilson offered the following resolution and moved its adoption:

#2018-2:

RESOLVED: That the salary of the Assessor be and hereby is as follows:

Assessor: $37,000.00

Clerk: $12.98 per hour, not to exceed 35 hours a week and to be shared with the Code Enforcement Officer.

FURTHER RESOLVED: To authorize Supervisor to pay the Assessor in equal bi-weekly installments.

FURTHER RESOLVED: That the Board of Assessment Review be paid $35.00 per meeting attended for each member, other than Grievance Day when they will be paid $60.00.

Mr. Wilson offered the following resolution and moved its adoption:

#2018-3:

RESOLVED: That the salary of the Highway Superintendent be and hereby is $58,110.42 per year to be paid in equal Bi-weekly installments, and the Deputy Superintendent will be paid an annual salary of$2,000.00 to be paid bi-weekly.

Mr. Wilson offered the following resolution andmoved its adoption:

#2018-4:

RESOLVED: That the rate of pay for the Highway employees be and hereby is paid per the union contract.

FURTHER RESOLVED: That the Highway Superintendent be allowed $700.00 for office expenses.

FURTHER RESOLVED: That the Highway employees be reimbursed $140.00 for the purchase of work boots.

Mr. Wilson offered the following resolution and moved its adoption:

#2018-5:

RESOLVED: To appoint Todd Unislawski as full time Building Inspector/Code Enforcer with duties to include chimney inspection, to attend the meetings of the Zoning, Planning and Town Board, at an annual salaryof $35,000.00 to be paid in Bi-weekly installments. Ryan Fagan will remain until Todd Unislawski receives all his qualifications.

FURTHER RESOLVED: That Mr. Unislawski be allowed to hire a clerk at a salary of $12.98 per hour, not to exceed 35 hours a week, to be shared with the Assessor.

Mr. Wilson offered the following resolution andmoved its adoption:

#2018-6:

RESOLVED: To appoint the firm of Miller, Mannix, Schachner and Hafner, LLC to be contracted as Town Attorney for the year 2018at an hourly rate of $160.00 per hour.

FURTHER RESOLVED: That attorney expenses are not to exceed $50,000.00 annually.

#2018-7:

RESOLVED: To appoint Kevin Cope, M.D., as Health Inspector for 2018 at an annual salary of $500.00 to be paid quarterly.

RESOLVED: That all necessary expenses incurred for the use and benefit of the Town by Town officials in executing the duties of his or her office, such as books, stationary supplies, mileage, toll calls and postage be a Town charge.

#2018-9:

RESOLVED: That the rate per mile be hereby fixed at the federal rate (.545 per mile for 2018) for the actual and necessary travel by Town Officials and employees.

Mr. Wilson offered the following resolution and moved its adoption:

#2018-10:

RESOLVED: That the regular meetings of the Town Board will be held at 6:00 PM on the third Monday of each month, except the months of January and February when the meeting will be set on the 4th Monday of the month at 6:00 PM due to the Holidays.

RESOLVED: To hold workshop meeting the second Monday of each month at 5:30 PM when deemed necessary.

RESOLVED: To have a Deputy Supervisor at an annual salary of $1,000.00 to be paid bi-weekly and that Daryl Baldwin is appointed Deputy Supervisor.

Mr. Wilson offered the following resolution andmoved its adoption:

#2018-13:

RESOLVED: For the Town to hire one (1) Confidential Secretary for the court with a salary of $14.02 per hour, with benefits, not to exceed 40 hours per week including court hours.

FURTHER RESOLVED: For the Town to hire one (1) Court Clerk at $12.98 per hour to work 4 days per week, 7 hours per day and hours when court is in session.

Discussion: Daryl Baldwin says position, not person is funded and when Kathy retires a new person will have a 35 hours schedule.

Kathy Canary said the 40 hours for the position is not abnormal. Position is also not paid equal to others in the same position. She also is training a clerk and it is another job.

Daryl Baldwin stated it is her job to train another clerk.

Walt Lane says hours are not being cut, her over-time has been costly and the over-time is being cut back.

Kathy Canary stated court days are only twice a month and not 5 hours each time.

RESOLVED: To hire Allen Baurle as Janitor for the Town Hall with a salary of $12.98 per hour paid bi-weekly, not to exceed $12,010.00.

RESOLVED: To appoint Nancy Hart as Animal Control Officer with an annual salary of $8,568.00 to be paid in equal bi-weekly installments with $4,000.00 expenses.

RESOLVED: That Nancy Hart is appointed Registrar of Vital Statistics at an annual salary of $3,125.28 to be paid in equal bi-weekly installments.

FURTHER RESOLVED: That Caitlin Hart is appointed Deputy Town Clerk/Deputy Registrar at an annual salary of $1,000.00.

RESOLVED: That the Town Clerk be permitted to engage a clerk and any assistants at a salary of $12.98 per hour, not to exceed 35 hours per week and $26,624.00 annually.

RESOLVED: That the NBT Bank and the Key Bank be designated as the depositories for Town Funds, and the Supervisor, Deputy Supervisor, Town Clerk, Tax Collector, and Justices shall deposit monies coming into their hands by virtue of their offices in such banks.

Mr. Wilson offered the following resolution andmoved its adoption:

#2018-21:

RESOLVED: That the Town renew its membership in the NYS Association of Towns for the year 2018 at a fee of $1,000.00.

FURTHER RESOLVED: That the Town renew its membership in the Adirondack Association of Towns and Villages for 2018 at a fee of $100.00, and to renew its membership in the Fulton Co. Regional Chamber of Commerce at a cost of $285.00 for the year 2018,and pay the NYS Planning Association dues for the year 2018 at a cost of$125.00 or at the 2018 rate.

#2018-22:

RESOLVED: That the Superintendent of Highways be authorized to purchase equipment, tools, and implements for the use of the Town in highway maintenance, construction, re-construction, snow plows or other devices for the removal of snow from the highways without prior approval of the Board in the amount not to exceed $8,000.00 for 2018.

#2018-23:

RESOLVED: That the Full Time, regular, employees, and elected/appointed officials be protected with health insurance and 90 percent of the cost will be paid by the Town, with all enrollees to pay a portion (10%) of their premium costs.

Mr. Wilson offered the following resolution andmoved its adoption:

#2018-24:

RESOLVED: That the Highway Superintendent be authorizedto act on behalf of the Town in the purchase of any items for sale by the NYSDOT, the NYS Thruway Authority, the Federal Surplus property, and Auctions International, and the Town will honor any and all commitments made by him up to $10,000.00, not to exceed the Highway equipment budget.

#2018-25:

RESOLVED: That the following Holidays be approved as paid holidays for Full Time, Regular Town Hall employees: New Year’s Day, Martin Luther King’s Birthday, President’s Day, Memorial Day, Fourth of July, Labor Day, Columbus Day, Election Day, Veteran’s Day, Thanksgiving Day, Day after Thanksgiving and Christmas.

BE IT FURTHER RESOLVED:The same holidays be approved for the Town Hall , Regular, Part Time employees at half pay.

RESOLVED: That the following provision be provided forTown Hall, regular, full time employees:

Vacation 0-4years 1 week

5-9 years 2 weeks

10+years 3 weeks

Three days off for adeath in the immediate family (per policy manual)

One day per month sick leave (may accumulate for up to 60 days)

Time and a half is paid after 40 hours per week.

BE IT FURTHER RESOLVED:That Part Time Regular Town Hall employees be provided with half the vacation time of full time employees.

RESOLVED: to contract with Fulton Co. Planning Dept. to render planning services with regard to land use and community planning, and to compensate the county in 4 quarterly payments,in 2018 totaling up to $7,000.00.

RESOLVED: To hold the Planning Board meetings on the second Tuesday of each month at 6:00 PM and to appoint Sean Geraghty as Secretary to the Planning Board, and that the members must attend at least 8 meetings a year and get the required training.

RESOLVED: That the Supervisor is authorized to reimburse Town Retirees, age 65 and over and covered under MVP Gold, at 100% for prescription drugs and medical expenses.

Discussion: Walt Lane reiterated the need to put this issue on agenda for future as there must be changes made for future retirees.

RESOLVED: That the Supervisor is authorized to set up HRA for all MVP Liberty Silver enrollees at a rate of 2/3 the deductible. Any additional medical costs not covered by insurance will be the responsibility of the insured.

RESOLVED: To establish the Standard Work Day as seven (7) hours for the elected and appointed officials established for the Town of Johnstown under NYS and Local Retirement System Section 315.4 for Regulation on Reporting for Elected or Appointed Officials.

** Nancy Hart requested that Res. 2018-26 be revisited for the Town Hall Employees vacation schedule. She requested the amount of weeks’ vacation be changed as follows:

Res. #2018-26: Motion made by Walt Lane to amend Resolution #2018-26 for Town Hall, Regular, full time employees :

Vacation 0-1 years 1 week

With the rest of Res.2018-26 to remain the same.

Discussion: Walt questioned amount of weeks earned after 10 years, and Jack Wilson stated they would address that at a later date.
